Анотація

Досліджується практика врегулювання відносин інтелектуальної власності у договорах про співробітництво/виконання досліджень і розробок (ДР) між науковими уста-
новами, університетами та компаніями в ЄС, США. Показано істотну роль, яка відве-
дена в ЄС, США, на міжнародному рівні розробленню та використанню модельних
договорів ДР з різними варіантами застережень стосовно об’єктів права інтелектуаль-
ної власності. Визначено принципи розподілу прав інтелектуальної власності та вико-
ристання результатів досліджень у договорах ДР, що доцільно застосовувати у прак-
тиці укладання договорів ДР в Україні.
