ОБ’ЄКТИ, ЗГЕНЕРОВАНІ КОМП’ЮТЕРНОЮ ПРОГРАМОЮ (ШТУЧНИМ ІНТЕЛЕКТОМ) БЕЗ БЕЗПОСЕРЕДНЬОЇ УЧАСТІ ЛЮДИНИ: ПЕРШИЙ СВІТОВИЙ ДОСВІД ПРАВОВОЇ ОХОРОНИ

Анотація

Ключові слова: штучний інтелект, правова охорона, sui generis, авторське право, інтелектуальна власність

Стаття присвячена аналізу права sui generis на неоригінальні об’єкти, згенеровані комп’ютерною програмою без безпосередньої участі людини, відповідно до ст. 33 нового Закону України «Про авторське право і суміжні права». Надано характеристику усім елементам нового правового режиму, виявлено низку дискусійних аспектів, які стосуються
визначення об’єкта правової охорони, суб’єкта права sui generis, умов набуття цього права та моменту його виникнення, обсягу охоронюваних прав. Зроблено пропозиції, які сприятимуть удосконаленню правового регулювання цієї сфери та підвищенню ефективності правозастосування у ній.
