Перспективи створення Багатостороннього інвестиційного суду та потенційний вплив цієї інституції на національну систему правової охорони та захисту прав інтелектуальної власності

У статті розглянуто питання впливу інвестиційних спорів «інвестор-держава» на національні системи правової охорони та захисту прав інтелектуальної власності держав, що стали стороною таких спорів; шляхи вирішення такого впливу, запропоновані Європейським Союзом в угодах про вільну торгівлю із, відповідно, Канадою та Тунісом. Шляхом порівняльного аналізу вказаних угод виділено типові положення, що регулюють питання захисту іноземних інвестицій і мають вплив на систему прав інтелектуальної власності.
